Zara takes Thilikó to court for copyright infringement

Retail giant Zara and its parent company Inditex are taking Los Angeles-based 'slow' fashion brand Thilikó to court over a “serial” scheme of copyright infringement.

The fashion brand is accusing Thilikó of false advertising and deceptive trade acts in order to mislead consumers about the source of its apparel and accessories.

According to the complaint, filed in a New York federal court on 4 January 2023, Zara and Inditex allege that Thilikó and its owner Queenie Williams have greenwashed their business and are passing off Zara’s fashion items as their own. This includes going so far as to obtain Zara garments, replacing the Zara tag with Thilikó labels, as well as listing the items for sale with “Exorbitant mark-ups."

The two-year-old brand, which sells products on its independent e-commerce site and through other online retailers, allegedly aims to “dupe the public” by selling misbranded products. The company also alleges that the defendants have also used copyrighted photographs that appear on Zara’s website.

Zara and Inditex are seeking monetary damages and injunctive relief to bar Thilikó from infringing copyrighted photos, “offering, advertising, or promoting any product or service making false or misleading representations or descriptions of fact, in any medium, regarding Zara products.”

Zara was recently named the most popular second-hand brand, with over 670,000 listings on reselling platforms Depop, eBay, Vestiaire Collective and ASOS marketplace.
