{"id":223869,"date":"2023-01-13T06:00:09","date_gmt":"2023-01-13T06:00:09","guid":{"rendered":"https:\/\/www.theindustry.fashion\/?p=223869"},"modified":"2023-01-13T17:40:33","modified_gmt":"2023-01-13T17:40:33","slug":"adidas-loses-court-battle-against-thom-browne-over-three-strip-design","status":"publish","type":"post","link":"https:\/\/www.theindustry.fashion\/adidas-loses-court-battle-against-thom-browne-over-three-strip-design\/","title":{"rendered":"Adidas loses court battle against Thom Browne over three-strip design"},"content":{"rendered":"<p><strong>It has been ruled that <a href=\"https:\/\/www.thombrowne.com\/uk\/\">Thom Browne<\/a>\u2019s parallel stripe designs were \"not likely to cause consumer confusion with <a href=\"https:\/\/www.adidas.co.uk\">Adidas' <\/a>products\", putting an end to the court trial that began on 3 January 2023.<\/strong><!--more--><\/p>\n<p>A Manhattan jury said that <span style=\"color: #ff0000;\"><a style=\"color: #ff0000;\" href=\"https:\/\/www.theindustry.fashion\/the_directory\/adidas\/\">Adidas<\/a><\/span>\u00a0failed to show how luxury brand Thom Browne Inc's use of stripes on its clothing infringed its signature three-stripe trademark.<\/p>\n<p>Thom Browne argued that the brands \"operate in different markets, serving different customers, and offer their products at strikingly different price points.\"<\/p>\n<p>Not only this, but the designs in question have a differing number of stripes. The fashion house previously used a three-bar design on its clothing, however it switched to the four-stripe design after Adidas objected in 2007.<\/p>\n<p>Bloomberg Law reported that Robert Maldonado, one of Thom Browne's lawyers, argued during closing statements that Adidas \u201cdoes not own stripes.\u201d<\/p>\n<div id=\"attachment_223874\" style=\"width: 970px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-223874\" class=\"wp-image-223874 size-full\" src=\"https:\/\/www.theindustry.fashion\/wp-content\/uploads\/2023\/01\/0x0-1.jpg\" alt=\"thom Browne\" width=\"960\" height=\"540\" srcset=\"https:\/\/www.theindustry.fashion\/wp-content\/uploads\/2023\/01\/0x0-1.jpg 960w, https:\/\/www.theindustry.fashion\/wp-content\/uploads\/2023\/01\/0x0-1-300x169.jpg 300w, https:\/\/www.theindustry.fashion\/wp-content\/uploads\/2023\/01\/0x0-1-768x432.jpg 768w\" sizes=\"(max-width: 960px) 100vw, 960px\" \/><p id=\"caption-attachment-223874\" class=\"wp-caption-text\">Thom Browne leaving court on 3 January 2023<\/p><\/div>\n<p>According to court documents, Adidas planned to ask for \u00a36.4 million ($7.8 million) in damages, plus additional punitive damages and a cut of Thom Browne's infringing sales. It also hoped for a court order to stop Thom Browne from using the designs in the future<\/p>\n<p>A spokesperson for Adidas said that the company was disappointed with the outcome but will \"continue to vigilantly enforce our intellectual property, including filing any appropriate appeals.\"<\/p>\n<p>Adidas also sued New York designer Thom Browne's brand in 2021 over its four-bar and \"Grosgrain\" stripe patterns on its shoes and activewear.<\/p>\n<p>This is only one example of Adidas' trademark battles.
