{"id":164088,"date":"2021-02-08T13:30:57","date_gmt":"2021-02-08T13:30:57","guid":{"rendered":"https:\/\/www.theindustry.fashion\/former-arcadia-staff-to-launch-legal-battle-over-redundancies\/"},"modified":"2021-08-06T12:10:12","modified_gmt":"2021-08-06T12:10:12","slug":"former-arcadia-staff-to-launch-legal-battle-over-redundancies","status":"publish","type":"post","link":"https:\/\/www.theindustry.fashion\/former-arcadia-staff-to-launch-legal-battle-over-redundancies\/","title":{"rendered":"Former Arcadia staff to launch legal battle over redundancies"},"content":{"rendered":"<p><strong>A group of more than 150 former Arcadia staff<\/strong> are to launch a legal battle against Sir Philip Green\u2019s retail empire over their redundancies.<\/p>\n<p><!--more--><\/p>\n<p>The \u201cdevastated\u201d staff members have <strong>claimed that Arcadia failed to follow the correct consultation procedures<\/strong> when making redundancies.<\/p>\n<p>Thousands of staff face redundancy after Deloitte, administrators for Arcadia, sold the retail group\u2019s brands and stock but <strong>confirmed its entire store portfolio is set to shut.<\/strong><\/p>\n<p>Last week, the insolvency specialists said <strong>around 2,500 jobs would go as a result of the sale of the Topshop, Topman, Miss Selfridge<\/strong> and HIIT brands to ASOS.<\/p>\n<p>On Monday morning, <strong>Deloitte said another 2,450 staff have been told that their jobs will be lost<\/strong> after <a href=\"https:\/\/www.theindustry.fashion\/boohoo-buys-of-dorothy-perkins-wallis-and-burton-in-25-2m-deal\/\">Boohoo bought Dorothy Perkins, Wallis and Burton<\/a> for \u00a325.2m but would close all stores.<\/p>\n<p>One former Miss Selfridge worker involved in the legal claim, who asked not to be named, said he<strong> received the news of redundancies while on a call with a representative from HR.<\/strong><\/p>\n<p>One former worker at Topshop\u2019s flagship Oxford Street store has also said she was <strong>asked to volunteer to work until 12 February to help clear stock or face having her wages halted<\/strong> with immediate effect.<\/p>\n<p>Aticus Law, which is representing the staff, said it has also already received calls from staff impacted by Boohoo\u2019s acquisition of Arcadia brands.<\/p>\n<p>The move will see the ex-staff take Arcadia Group go to court for their case<strong> pursuing a Protective Awards claim for compensation<\/strong> to be heard by an employment tribunal.<\/p>\n<p>If successful, those involved in the challenge will be<strong> entitled to up to eight weeks\u2019 worth of pay in compensation, with a cap of \u00a3538 per week,<\/strong> the firm said.<\/p>\n<p>Hannah Stewart-MacCallum of Aticus Law said: \u201cThis has been a particularly difficult time for the Arcadia Group employees given the huge amount of speculation about whether there would be job losses as a result of the ASOS acquisition.<\/p>\n<p>\u201c<strong>Many found themselves continuing to turn up to work every day to process online orders<\/strong> amidst the continued uncertainty.<\/p>\n<p>\u201cHowever, despite the time it has taken to complete the deal, we\u2019re receiving calls from former staff who say they were <strong>made redundant with immediate effect which, if that is the case, is in breach of employment law.<\/strong><\/p>\n<p>\u201cObviously we\u2019re in the very early investigative stages here, but we\u2019re doing all we can to process the information and ensure people get the support they need.\"<\/p>\n<p>Before Christmas, <strong>Deloitte sold the Evans plus size brand to Australia's City Chic Collective<\/strong> in a deal that also did not include its stores.
